Acceptable Use Policy

Welcome to Eaglecart.

This Acceptable Use Policy (the "Policy") explains the rules, standards and responsibilities that apply when you use Eaglecart websites, applications, software, APIs and related services (together, the "Services").

This Policy is designed to protect the security, reliability, integrity and reputation of the Eaglecart platform and its users.

By using the Services, you agree to comply with this Policy.


1. Introduction

Eaglecart is a UAE-based business management platform providing ecommerce websites, online stores, Point of Sale (POS), Warehouse Management Systems (WMS), workshop management software, inventory management, customer management, quotations, invoicing, reporting, AI features and related business services.

All users are expected to use the Services responsibly, lawfully and ethically.


2. Relationship to Our Other Agreements

This Policy forms part of, and is incorporated into, the Eaglecart Terms of Service. A breach of this Policy is a breach of the Terms of Service.

This Policy should be read together with:

  • The Eaglecart Terms of Service
  • The Eaglecart Privacy Policy
  • The Eaglecart Cookie Policy
  • The Eaglecart Security Policy

Where this Policy conflicts with the Terms of Service, the Terms of Service prevail.


3. Eligibility and Age

To open and hold an Eaglecart account you must be at least 18 years old and legally able to enter into a binding contract.

Merchants are responsible for ensuring that their storefronts, products and marketing comply with all applicable laws relating to minors, including restrictions on selling age-restricted products and any obligations relating to the protection of children in the digital environment.


4. Compliance with Laws

Users must comply with all applicable laws, regulations and governmental requirements, including but not limited to:

  • Consumer protection laws
  • Privacy and data protection laws
  • Tax regulations, including VAT and electronic invoicing requirements
  • Intellectual property laws
  • Ecommerce and electronic transactions regulations
  • Anti-money-laundering and sanctions requirements
  • Advertising and marketing regulations
  • UAE federal law, and the law of any emirate or free zone in which you operate

Users operating outside the UAE remain responsible for compliance with the laws applicable to them and to their customers.


5. Account Responsibilities

Users are responsible for:

  • Maintaining accurate account information
  • Protecting login credentials
  • Managing user permissions
  • Monitoring staff activity
  • Ensuring compliance with this Policy

Merchants are responsible for all activity conducted through their accounts.


6. Merchant Obligations to Customers

If you use Eaglecart to sell to customers, you are the seller. Eaglecart is not a party to the sale, and you remain solely responsible to your customers.

Merchants must:

  • Describe products and services accurately, and not mislead customers about price, availability, condition, origin or specification
  • Display prices clearly, and state whether prices include VAT
  • Issue valid tax invoices where required
  • Publish delivery timeframes and delivery charges clearly before checkout
  • Publish a clear returns, refund, cancellation and warranty policy, and honour it
  • Handle customer complaints promptly and fairly
  • Provide accurate business contact details on their storefront
  • Comply with consumer protection law in every market they sell to

Eaglecart provides tools for policies, return rules, invoicing and customer communication. Using them is your responsibility, not ours.


7. Prohibited Activities

Users may not use Eaglecart for:

  • Illegal activities
  • Fraudulent activities
  • Misleading or deceptive practices
  • Identity theft
  • Phishing campaigns
  • Spam communications
  • Harassment or abuse
  • Unauthorised data collection
  • Distribution of malware or viruses
  • Hacking attempts
  • Security testing without authorisation
  • Circumvention of platform restrictions
  • Unauthorised access to systems or accounts

8. Prohibited and Restricted Products and Services

Users may not sell, promote, distribute or facilitate:

  • Illegal products
  • Counterfeit goods
  • Stolen goods
  • Pirated software
  • Copyright-infringing content
  • Trademark-infringing products
  • Illegal drugs and controlled substances
  • Illegal gambling services
  • Fraudulent financial services
  • Weapons, ammunition and explosives
  • Adult or sexually explicit content
  • Any product prohibited by applicable law

Certain products are restricted rather than prohibited. You may sell them only if you hold every licence, permit or approval required by the relevant authority, and you must be able to produce evidence of it on request. Restricted categories include:

  • Alcohol and tobacco products
  • Pharmaceuticals, medical devices and health supplements
  • Food and beverages
  • Cosmetics and personal care products
  • Telecommunications and radio equipment
  • Financial and payment services
  • Any product requiring approval from a UAE federal or local authority

Eaglecart may remove such content without notice.


9. Sanctions and Financial Crime

You may not use the Services to transact with any person, entity or jurisdiction subject to applicable sanctions, or to facilitate money laundering, terrorist financing or any other financial crime.

You must not use the Services to disguise the origin of funds, structure transactions to avoid reporting requirements, or process payments on behalf of an undisclosed third party.

Eaglecart may suspend or terminate accounts and report activity to the competent authorities where required by law.


10. Intellectual Property

Users must respect intellectual property rights and may not:

  • Upload copyrighted content without permission
  • Infringe trademarks
  • Infringe patents
  • Misappropriate trade secrets
  • Use unauthorised brand assets

Eaglecart may remove infringing content and suspend violating accounts.


11. Intellectual Property Complaints

If you believe content on the Eaglecart platform infringes your intellectual property rights, send a written complaint to [email protected] including:

  • Your name, organisation and contact details
  • Identification of the right you own and evidence of ownership
  • The exact location of the infringing content, including the URL
  • A statement that you believe in good faith that the use is not authorised
  • A statement that the information in your complaint is accurate

We will review complete complaints and may remove or disable access to the content while we do so.

If your content is removed and you believe the removal was mistaken, you may submit a counter-notice to the same address explaining why. We will consider it and may restore the content.

We may suspend or terminate accounts that are the subject of repeated valid complaints.


12. Data Protection and Privacy

When you use Eaglecart to collect and process personal data about your own customers, staff or contacts, you are the data controller and Eaglecart is the data processor. You decide why and how that personal data is used. We process it in order to provide the Services, in accordance with your instructions and applicable law.

As controller, you are responsible for:

  • Having a lawful basis for every processing activity
  • Obtaining valid consent where consent is the basis you rely on
  • Publishing your own privacy notice on your storefront, explaining what you collect and why
  • Responding to requests from individuals to access, correct, delete or object to the processing of their data
  • Ensuring any third party you share data with is entitled to receive it
  • Assessing whether your processing is high-risk, and taking the steps the law requires if it is

This applies with particular force where you export customer data from Eaglecart to advertising or marketing platforms, or where you use location, device or behavioural data. Exporting personal data to a third-party advertising platform is a processing activity in its own right, and you are responsible for its lawfulness.

You may not process personal data through Eaglecart in a way that breaches applicable data protection law. Further detail is set out in the Eaglecart Privacy Policy.


13. Marketing Communications

If you use Eaglecart to send marketing by email, SMS or any other electronic channel, you are the sender and you are responsible for it.

You must:

  • Obtain and be able to prove the recipient's consent before sending marketing
  • Clearly identify yourself as the sender in every message
  • Include a working and easy way to unsubscribe in every message
  • Act on unsubscribe requests promptly and permanently
  • Not send marketing to purchased, scraped or rented contact lists
  • Not disguise, falsify or conceal the origin of a message

Placing an order with you is not, by itself, consent to receive unrelated marketing.


14. Security Requirements

Users are responsible for maintaining account security. Recommended practices include:

  • Strong, unique passwords
  • Multi-factor authentication where available
  • Secure devices
  • Updated software
  • Protection of API keys

15. Security Incidents

You must notify Eaglecart immediately at [email protected] if you become aware or suspect that:

  • Your account credentials have been lost, stolen or misused
  • An unauthorised person has accessed your account or your data
  • Personal data held in your Eaglecart account has been exposed, altered or destroyed without authorisation

Eaglecart will notify affected merchants and competent authorities where required by applicable law.

As controller, you remain responsible for notifying the competent regulator and affected individuals where the law requires it.


16. Platform Integrity

Users may not:

  • Interfere with platform operations
  • Overload platform resources
  • Circumvent technical limitations
  • Reverse engineer platform functionality
  • Attempt unauthorised system access
  • Conduct automated attacks
  • Exploit vulnerabilities

17. Data Usage Restrictions

Users may not:

  • Collect personal data without authorisation
  • Sell personal data unlawfully
  • Violate privacy regulations
  • Access data that does not belong to them
  • Misuse customer information

All data processing must comply with applicable privacy laws.


18. Artificial Intelligence

Eaglecart provides AI-powered features. You may not use them to:

  • Generate unlawful content
  • Create misleading information
  • Facilitate fraud
  • Generate malicious code
  • Violate intellectual property rights
  • Make decisions about individuals that produce legal or similarly significant effects, without human review

AI output can be wrong. AI-generated content may contain errors, omissions or inaccuracies. You are responsible for reviewing any AI-generated content before you publish it, send it to a customer, or rely on it. Eaglecart does not warrant the accuracy of AI-generated output.

You must not submit confidential, sensitive or personal information to an AI feature unless you are authorised to do so and the feature is intended for that purpose.

You remain responsible for all content generated using AI-powered features, exactly as if you had written it yourself.


19. Staff and Contractor Access

Merchants may authorise employees, contractors and staff members to access their accounts. The account owner remains responsible for:

  • User permissions
  • User activity
  • Security practices
  • Compliance with this Policy

Access should be removed promptly when a person no longer needs it.


20. Monitoring and Enforcement

Eaglecart may investigate suspected violations of this Policy. We may monitor platform activity where reasonably necessary to:

  • Protect users
  • Protect the platform
  • Investigate abuse
  • Comply with legal obligations

21. Violations and Enforcement Actions

Violations may result in:

  • Content removal
  • Account suspension
  • Service restrictions
  • Account termination
  • Permanent bans
  • Legal action
  • Reporting to the competent authorities

Enforcement action may be taken without prior notice where necessary.


22. Appeals

If we take enforcement action against your account and you believe it was mistaken, you may appeal by writing to [email protected].

Tell us your account details, what action was taken, and why you believe it was wrong. Include any evidence.

We will review your appeal and tell you the outcome. Where an enforcement action was taken in error, we will reverse it.

Appeals are not available where the law prevents us from restoring an account or from disclosing the reason for an action.


23. Suspension, Termination and Your Data

You own your business data. Suspending or terminating an account does not transfer ownership of your data to Eaglecart.

Where your account is terminated, you may export your business data for 30 days from the date of termination. After that period, your data may be permanently deleted.

We may retain certain data for longer where the law requires it, or where it is needed to resolve a dispute, prevent fraud, or enforce our agreements.


24. Reporting Violations

If you become aware of a violation of this Policy, report it to [email protected].

Please include:

  • What happened, and when
  • The store, account or URL involved
  • Any evidence, such as screenshots or order references
  • Your contact details, so we can follow up

We take reports of fraud, abuse, security incidents, copyright infringement and illegal activity seriously, and we investigate them.


25. Changes to This Policy

Eaglecart may update this Acceptable Use Policy from time to time. Updated versions will be published on our website and may be communicated by email or platform notification.

Continued use of the Services after updates become effective constitutes acceptance of the revised Policy.


26. Governing Law and Jurisdiction

This Policy shall be governed by and construed in accordance with the laws of the United Arab Emirates as applied in the Emirate of Sharjah.

Any dispute arising out of or relating to this Policy shall be subject to the exclusive jurisdiction of the competent courts of the Emirate of Sharjah, United Arab Emirates.
