Domain Name Registration Agreement

This Domain Registration Agreement ("Agreement") is entered into by and between Tucows Domains Inc. ("Tucows") and you ("Registrant"), and is made effective as of the date of your electronic acceptance. This Agreement is offered through Eaglecart (the "Reseller").

1. THE ROLE OF THE PARTIES

You acknowledge that Eaglecart is a Reseller for OpenSRS/Tucows, an ICANN-accredited registrar. You are entering into a contract with both the Reseller and Tucows. Any reference to "Registry" refers to the administrator of the specific TLD (e.g., Verisign for .com).

2. INCORPORATION OF THE MASTER AGREEMENT (EXHIBIT A)

IMPORTANT: This Agreement expressly incorporates by reference the Tucows Master Registration Agreement (Exhibit A), which can be found at https://www.opensrs.com/docs/contracts/exhibita.htm. By agreeing to these terms, you acknowledge you have read and agree to all terms in Exhibit A, including the specific provisions for various Top-Level Domains (TLDs).

3. REGISTRANT OBLIGATIONS & WHOIS DATA

You agree to provide accurate, complete, and current information for the WHOIS database. You must update this information within seven (7) days of any change. Willful provision of inaccurate information is a material breach of this Agreement and may result in the immediate cancellation of your domain registration without refund.

4. FEES, RENEWALS, AND EXPIRATION

  • Payment: Registration and renewal fees must be paid in advance to Eaglecart.
  • No Refunds: Fees are non-refundable, even if the domain is cancelled, suspended, or transferred before the end of the registration term.
  • Expiration: It is your sole responsibility to renew your domain. Upon expiration, the domain will stop working and may be deleted or sold to a third party.
  • Redemption: Domains in the "Redemption Grace Period" will require significantly higher fees to recover, as set by the Registry.

5. DOMAIN DISPUTES (UDRP)

You agree to be bound by the ICANN Uniform Domain Name Dispute Resolution Policy (UDRP) and the Uniform Rapid Suspension (URS) policy. You agree that if a third party challenges your domain, you will indemnify Tucows and Eaglecart for all legal costs and expenses.

6. WHOIS PRIVACY SERVICE

If you purchase WHOIS Privacy, we will hide your personal data from the public directory. However, we are authorized to reveal your identity to comply with law enforcement, ICANN audits, or to resolve legal claims of trademark infringement or intellectual property violations.

7. LIMITATION OF LIABILITY

The total liability of Tucows and Eaglecart for any claim arising from this Agreement is limited to the amount you paid for the specific domain registration. We are not liable for lost profits, loss of data, or business interruption.

8. TLD-SPECIFIC TERMS (Registry Rules)

Different domain extensions have different rules. By registering these, you agree to the following:

  • .UK: You agree to the Nominet Terms (nominet.uk/go/terms).
  • .CA: You agree to the CIRA Registrant Agreement.
  • .US / .BIZ: You certify you meet the "Nexus" or "Business" requirements for these domains.
  • New gTLDs: You agree to the Acceptable Use Policies of the respective registries (Donuts, Radix, etc.).

9. GOVERNING LAW

This Agreement shall be governed by and interpreted in accordance with the laws of the United Arab Emirates. Any legal action or proceeding relating to this Agreement shall be brought exclusively in the courts of the United Arab Emirates. Notwithstanding the foregoing, for the adjudication of disputes concerning the use of the Registered Name, the Registrant shall also submit to the jurisdiction of the courts of the Registrant's domicile and where the Registrar (Tucows) is located.
